2. Acceptance of Terms

By accessing or using SimpleSockets (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you (or the organisation you represent) and Drewdan Limited.

3. The Service

SimpleSockets provides WebSocket infrastructure as a service, allowing developers to integrate real-time communication into their applications. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

4. Account Registration

To use the Service, you must register for an account. You agree to provide accurate, current, and complete information and to keep your account details up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You must notify us immediately of any unauthorised use of your account or any other security breach.

5. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy. You must not use the Service for any unlawful purpose or in any way that could harm, disable, or impair the Service or other users.

6. Fees and Payment

Certain features of the Service require payment of fees. All fees are stated in your chosen currency and are exclusive of VAT where applicable. Fees are charged in advance on a monthly basis unless otherwise stated.

We use Stripe to process payments. By providing payment details, you authorise us to charge the applicable fees to your payment method. We reserve the right to change our pricing at any time, with reasonable notice provided to existing subscribers.

Message bundles are non-refundable once consumed. Unused bundle messages do not roll over between billing periods.

7. Intellectual Property

All intellectual property rights in the Service, including but not limited to software, documentation, and branding, are owned by or licensed to Drewdan Limited. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.

You retain ownership of all data and content you transmit through the Service.

8. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you consent to our processing of your personal data as described therein.

9. Uptime and Service Levels

We aim to provide a reliable Service but do not guarantee 100% uptime. Planned maintenance will be communicated in advance where possible. We shall not be liable for losses arising from service interruptions beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Drewdan Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability to you in connection with these Terms shall not exceed the fees paid by you in the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.

11. Termination

You may cancel your account at any time through your account settings. We reserve the right to suspend or terminate your account immediately if you breach these Terms or our Acceptable Use Policy.

On termination, your right to use the Service ceases immediately. We may retain certain data for legal compliance purposes in accordance with our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by displaying a notice within the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
